Appeal against Capital Punishment and the Miscarriage of Justice in Palestine

On the evening of December 27, 1999, the Military State Security Court passed a death sentence on Corporal Hussein Hashem Abu Nahel for the killing of his relative policeman Ayman Mahmoud Abu Nahel in the course of a family fight.

This is the 27^th case of a death penalty adopted by the State Security Court since its establishment in 1994.

Despite repeated calls on the PNA to abolish this court by human rights organizations and other institutions of civil society, by the Legislative Council, and by the public at large, the State Security Court persists in its functions and in violating due process.

The proceedings in this latest case are a clear case of miscarriage of justice, particularly in the absence of the accused's apponted defense lawyer, the appointment by the court of military lawyers, and the refusal to hear witnesses on behalf of the defense.

Regardless of the gravity of the charges, Abu Nahel deserves a fair and legal trial-as do all others who had been sentenced by this court.

The death penalty is also an extreme and harsh sentence that violates human rights and contravenes all relevant universal charters and conventions.

MIFTAH appeals to you to sign its petition addressed to President Yasser Arafat calling upon him to :

1. Abolish the State Security Court and present all its cases before a civilian and properly constituted court.
2. Abolish the death penalty and refrain from endorsing the death sentence of Abu Nahel.
3. Carry out all necessary steps and measures to complete the reform and unification of the Palestinian judicial system and to ensure its independence and integrity.

contro la pena capitale e la mala giustizia in Palestina

La sera del 27 dicembre 1999, la Corte di Sicurezza di Stato militare ha promulgato una condanna a morte contro il caporale Hussein Hashem Abu Nahel per l'omicidio del poliziotto suo parente Ayman Hahmoud Abu Nahel durante una lite in famiglia.

Nonostante ripetuti appelli alle autorità palestinesi per l'abolizione di questa Corte da parte di organizzazioni per i diritti umani ed altre istituzioni della società civile, come il Consiglio legislativo, e dell'opione pubblica in generale, la Contre di Sicurezza di Stato persiste nelle sue funzioni e nella violazione del giusto processo.

Le procedure in quest'ultimo caso costituiscono un esempio lampante di cattiva giustizia, data in particolare l'assenza dell'avvocato incaricato della difesa dell'imputato, la nomina, a mezzo della Corte, di un avvocato militare e il rifiuto di dare udienza alle testimonianze in difesa dell'imputato.

Nonostante la gravità delle accuse, Abu Nahel ha diritto ad un processo giusto e nel quadro della legalità -come anche gli altri imputati condannati da questo Corte.

La pena di morte rappresenta inoltre una condanna estrema e brutale che viola i diritti umani e infrange tutte le carte e convenzioni internazionali.

MIFTH vi chiede di firmare la sua petizione diretta al Presidente Yasser Arafat perchè si impegni per :

1. l'abolizione della Corte di Sicurezza di Stato e la presentazione di tutti i casi da essa trattati di fronte ad un tribunale civile e propriamente costituito;
2. l'abolizione della pena di morte e la non esecuzione della condanna a morte nei confronti di Abu Nahel;
3. la messa in atto di tutte le misure necessarie per completare la riforma e l'unificazione del sistema giudiziario palestinese ed assicurare la sua indipendenza e integrità.
